Eklutna Trading 9cc reserves the right to alter/change the terms and conditions including the terms and what is covered and excluded by the warranty, without prior notice. The latest version of the terms and conditions including the warranty will supersede any previous version, physical and digital or in any other format, and may include the details listed in previous versions. A copy of the latest version of this document will be made available upon request or can be copied from this web page.
Ownership of goods only passes hands once all monies owed are paid in full and all items, including exchange parts or items as agreed upon as part of the sale conditions, owed to Eklutna Trading 9cc are returned to us in the condition which was agreed to, regardless of medium.
Placing an order with us, warrants that the information you provide to us when making an order for our products and/or services is accurate, without error nor is misleading in any way.
The terms and conditions stipulated below will apply to all sales of products and/or services provided by us to you, the customer.
Upon accepting the item, or fitting the item, you are in agreement to the terms and conditions stated here with.
If you purchase products and/or services by any means, the contract will not progress until either your order, received by any medium, is accepted by the earliest of our recorded acknowledgement of order or delivery of the products.
We reserve the right to dispatch products of a modified/similar design provided that any difference does not render the product unsuitable for any purpose other than it’s intended use.
Technical specifications are approximations unless otherwise stated. It is the customers duty to ensure the part is suitable for it’s application, please check with your mechanic.
You will not under any circumstances remove, amend, obfuscate or tamper with any of the trade marks, identification numbers, serial numbers, part numbers and/or names affixed to or marked on the product nor allow any third party to so. Doing so, without permission from management of Eklutna Trading 9cc, will render your warranty void.
Unless otherwise stipulated, all quotations, whether written or verbal, are valid only for 3 days from the date of publication. We reserve the right to alter/adjust prices of the products and/or services quoted, in any medium, at any time without notification to take into account any increase in our costs (including but not limited to the cost of materials, labour, transport or other overheads, any tax, duty or variation in exchange rates). We reserve the right to refuse service at our discretion.
All pamphlets, specifications, images of products, dimensions, descriptions and illustrations, guides and information, price lists and other advertising/descriptive material are understood to be an illustration of the products and services described in them. The information contained within all publications, print, online or other medium, is subject to change without prior notice.
No allowance will be taken into consideration, nor credit provided for items collected from our premises by you rather than delivered by us.
Unless otherwise stipulated, prices quoted exclude delivery costs to destinations in and outside of the borders of South Africa and we will select the mode of transport. The entire cost of any other mode of transport which you may specify will be borne by you, this includes any risks undertaken, as well as delivery locally or delivery & customs charges to locations outside of South Africa. If you are a Consumer, unless otherwise stated, the afore mentioned will apply
Pre-Installation Checks & Precautions
It is the duty of the customer and/or mechanic to make sure that the initial fault or cause of fault in the vehicle is identified and rectified.
Technical specifications are approximations unless otherwise stated. It is the customers duty to ensure the part is suitable for it’s application, please check with your mechanic. It is imperative that you, your mechanic and/or your engineer inspect the part immediately upon receipt and physically compare, to your original part, visually, and with the use tools and instruments where required, to ensure the part matches your original, exactly. Please refer to the installation checklist, you can download a copy by clicking here.
The complete cooling system has to be inspected. If the original radiator, water pump and/or cooling hoses(at least inspected to ensure of no leaks) are still used on the vehicle, they must be inspected thoroughly and replaced where necessary.
Timing components such as timing belt/chain, tensioner, etc. must be replaced.
The block and internal parts including the sump and oil sieve must be inspected and bolt holes cleaned thoroughly.
Fresh oil must be used and a new oil filter must be installed.
Complete heads may or may not be supplied with camshaft oil seal, which are normally found in a gasket set. It is your duty to check before fitment.
Complete heads have clearances set, clearances must checked before fitting the head but do not change/tamper with them in any way. If you feel there is a cause for concern, please contact us.
We do not, under any circumstances accept returns for items that have been used, this also includes any other item supplied with the part (example gaskets, bolts etc). We do not accept returns for items, where the packaging is missing or has sustained damage or is not in the original condition as supplied. The item and packaging must be fit for resale. If the incorrect item was dispatched we still cannot accept returns if the item and packaging is not in the original condition as supplied.
Please note that you do have the right to return a product or to cancel an order within the first 14 days following delivery by our courier, collection by yourself or your courier or your appointed representative (excluding special order items - See below). We do however reserve the right to refund your purchase minus any carriage charges that we have incurred in transporting, to and from, (as detailed below) and a handling charge up to 25% depending on the items value.
Special order items require a 50% non-refundable deposit since these parts are ordered specially from manufacturers or agents and they may be non-returnable or unfeasible to return. We will not be able to accept special order goods back for refunds, credit or exchange even if they were incorrectly supplied.
If you wish to return a product for exchange, it must be returned as per the initial paragraph regarding returns. We reserve the right to deduct our initial shipping fee, before passing credit to the new product, (i.e. the shipping fee that we have incurred in shipping the first product to you) and charge a handling charge of up to 25%. If the item has been used we reserve the right to refuse exchange or charge a fee at our discretion.
Refunds or exchanges will only commence once the return item/s is/are in our possession.
We will under no circumstances accept a cylinder head or other part that has changed colour while in your possession due to exposure to excessive heat.
Upon receipt, all products will be inspected at our discretion, we reserve the right to refuse a credit/exchange should we feel the item is in a condition that is unacceptable.
If we have correctly supplied the product as ordered then we will reimburse the product costs minus a handling charge of 25% of the order value. You are legally obligated to take reasonable care of the products while they are in your possession and on your premise, bearing in mind that if the item was not on your premises, you are still responsible. If you fail to comply with this obligation, we may have a right of action against you for compensation.
Any item, damaged or undamaged, returned to us must be accompanied by a written document stating reason for return. Your name and address must be included along with a copy of the invoice.
Please note that you will have to return the goods to us, i.e. you are responsible for the cost to return the item to us and for ensuring that it is returned to us in a condition in which it can be resold (as per the initial paragraph regarding returns), unless alternative methods have been agreed upon with customer services prior to the item being returned. Any items returned to us damaged or not in its original condition due to you not packaging sufficiently, will not be entertained.
Any item sent to the correct address and returned as either not accepted or that you have relocated, will be subject to you being responsible for all shipping charges for the new item to be resent to you and for the item to be returned to us, plus the 25% handling charge
Damaged/incorrect Upon Receipt
If the goods have been damaged in transit by the courier or have been incorrectly supplied at the time of delivery - In this case we reserve the right to replace the product. The item must be returned before a replacement will be provided, no exceptions.
If you wish to return for refund, you must do so within 14 days, there after we will accept returns subject to our discretion and will reimburse the product costs minus a handling charge of up to 25% of the order value. Please contact us and include your personal details along with a brief explanation of the problem. NOTE: You must inform us of damaged deliveries within a reasonable period of time i.e. 24hrs. We are unable to accept responsibility for damage to goods beyond this period.
Any claim of an item being faulty after fitted please refer to “Warranty” below.
Call out charges are charged at a rate of R1.40/km to reach destination and return. Plus a further R250 per hour if there is no fault with the part after a claim of fault.
Assembled Cylinder Head
Exchange unit transactions must have the old unit (including all internal parts depending on the type of unit ordered, i.e complete sets of valves, springs, collars, collettes, rockers, camshaft, rocker shaft) returned to us within 3 days, in a condition in which it can be reused bar any fair ware, excludes breakages.
On occasion a deposit/surcharge may be required and will be refunded once the exchange unit is returned to us within 14 days. After 14 days you will forfeit your deposit/surcharge but will still be under obligation to return the parts, in the condition as prescribed above.
If returned unit is received damaged, either because you failed to inform us before the purchase agreement that it was damaged or because you failed to package it sufficiently, you will forfeit your deposit/surcharge to defer costs and you will still be under obligation to return the parts, in the condition as prescribed above. In the event that the unit is returned damaged due to poor handling during transit with sufficient evidence proving the couriers negligence no matter how sufficiently the item was packaged, you will still be reimbursed.
Please note we do not keep any surcharge beyond what is required. If we fail to reimburse you within 2 weeks of returning the old unit, please contact us.
Only the parts supplied by us are under warranty, with no exception, we will not entertain any claims for labor costs, recovery, transport or incidental, indirect, special or consequential damages such as, but not limited to, physical injuries or property damage, loss of time, loss of use of the vehicle, inconvenience, rental vehicle charges, towing charges or accommodations resulting from a defect in or failure of the part. Warranty starts from date of purchase, not when it is resold or fitted to a vehicle. We will not entertain any claim where a vehicle was unable to be used, for any reason including being impounded by police, until after the warranty period has expired. Any claim where the fault is not visible, or otherwise apparent, must be supported by an engineer’s report from a certified, independent, engineer, proving fault, and the proof of purchase (in some instances regardless of the fault being apparent we may still request an engineer’s report. Any new item which is tampered with (i.e removing camshaft, removing cam holding caps, tampering with clearances…etc.) after receiving as supplied, will render your warranty void. Attempted removal/tampering with serial numbers will render your warranty void. Failure to comply with any reasonable request, that is not beyond your ability, should a dispute arise will render your warranty void. Warranty does not cover over heating, ensure you have changed cooling system to avoid further complications, nor does it cover failure do due to incorrect timing settings or timing faults due to frail/used timing components. Please refer to the installation checklist.
Warranty is valid in the name of the purchaser & is not transferable. Terms of this warranty applies to both new and used parts, subject to further stipulation below. In the event that a guarantee is listed/stated, it is most likely an error, it will not hold true.
New parts, including cylinder heads, blocks, cranks, sub assemblies and engines, sold for use in passenger vehicles and/or taxis that used in a commercial capacity, e.g are only under warranty for 30 days from purchase. Parts sold for use in vehicles other than passenger vehicles or taxis are under warranty for 1 year from the date of sale or until 10,000km of usage has been reached, whichever occurs first will apply.
Used parts, including cylinder heads, blocks, cranks, sub assemblies and engines are sold as is and is supplied with a 30 day start up warranty on condition you get the part reconditioned. Diesel type engines, blocks and sub assemblies carry a start up warranty. We recommend testing and refurbishing before fitting.
Trade: Blocks, sub-assemblies and head, block, sump assemblies supplied to trade customers which a claim is made against must be inspected by the trade customer, with consent from Eklutna Trading 9, prior to being returned to Eklutna Trading 9. We will only deal with the purchaser/company of the part and not the end user. All above conditions still apply.
